1. Scope and Entity Responsibility
This Policy explains how Monetic Technologies LLC (“Monetic,” “we,” “our,” or “us”) and its licensed affiliates, including Monetic Payments LLC, collect, use, disclose, and protect information when you access or use the Monetic Pay mobile application, merchant dashboard, and related services (“App” or “Services”). Monetic Technologies LLC is the data controller for the App’s interface, user experience, and data hosting; Monetic Payments LLC and other affiliates act solely as licensed service operators or contractual counterparties for payment, onboarding, or compliance functions under limited scope. Use of Monetic Pay constitutes your acknowledgment and acceptance of this Policy.
2. Information We Collect
2.1 Information You Provide
- Full legal name, date of birth, address, and contact information
- Email, phone number, and authentication credentials
- Government-issued identification documents
- Business information (for merchants) including entity name, ownership, and tax identifiers
- Support inquiries, feedback, or communications
2.2 Automatically Collected Information
- Device and browser identifiers, IP address, system configuration
- Usage activity within the App (login timestamps, navigation events)
- Location data, if you enable location services
- Cookies, analytics, and telemetry data to detect fraud or abuse
2.3 Financial and Transactional Data
- Wallet addresses and balance snapshots
- Transaction history, counterparties, and payment metadata
- Linked card, account, or payment instrument identifiers (through regulated partners)
- Compliance and screening results required under AML/KYC laws
3. How We Use Your Information
We process information only as permitted by law and contractual necessity: to create, verify, and maintain accounts; facilitate payments and stablecoin conversions; meet regulatory obligations (KYC/AML/sanctions); detect and prevent fraud or prohibited activity; provide support and product updates; comply with audit, tax, and recordkeeping duties; and evaluate system performance and security. We never sell personal information.
4. How We Share Information
We share data only as necessary to deliver Services or comply with law, including with regulated financial and technology partners (on/off-ramp, card issuance, settlement, fraud screening), cloud/analytics/infrastructure providers, regulators/law enforcement/auditors when legally required, and contracted affiliates or vendors under strict data-processing agreements. Each partner maintains independent compliance and privacy obligations.
5. Data Retention
We retain data while your account is active, as necessary for recordkeeping/AML/tax/contractual obligations, and for a reasonable period for fraud, disputes, or regulatory requests—after which it is securely deleted or anonymized. Schedules may differ by partner system and jurisdiction.
6. Security Measures and Risk Allocation
We implement TLS encryption, encrypted storage of identifiers, MFA, role-based access, network segmentation, monitoring, and intrusion detection. However, no platform is perfectly secure. You acknowledge your use occurs over third-party networks we do not control; Monetic is not liable for breaches or interruptions caused by partners, telecom providers, internet outages, blockchain congestion, or external compromise; and Monetic’s aggregate liability is limited to the fees you paid in the preceding three (3) months.
7. Compliance and Legal Use
We comply with applicable laws and frameworks (e.g., BSA/FinCEN guidance, GDPR/CCPA principles; PCI DSS handled by regulated partners). Use of Monetic Pay for illegal or prohibited transactions is forbidden and may result in suspension and required reporting.
8. Your Rights and Choices
You may request access, deletion, or correction of your data; withdraw consent to non-essential processing; and opt out of marketing. Contact support@monetic.xyz. Certain records cannot be deleted where retention is required by law or contract.
9. International Data Transfers
If you access the App from outside the U.S., your data may be processed or stored in the U.S. or other jurisdictions where we or partners operate.
10. Third-Party Links and Integrations
Third-party services integrated with the App have independent privacy practices; we disclaim responsibility for data collection/use/breach outside our control.
11. Business Transfers
If Monetic undergoes a merger, acquisition, restructuring, or asset transfer, personal data may transfer to the successor subject to the same protections.
12. Limitation of Liability and Indemnification
To the fullest extent permitted by law, we disclaim warranties regarding uninterrupted service, data accuracy, or partner performance; you agree to indemnify Monetic Technologies LLC, Monetic Payments LLC, and their affiliates from claims arising from your use, policy breaches, or third-party use of your credentials; Monetic is not responsible for acts/omissions of regulated partners, card issuers, blockchain networks, or counterparties.
13. Children’s Privacy
Monetic Pay is not intended for anyone under 18 years of age.
14. Updates to This Policy
We may amend this Policy periodically. Updates will be published in-app and on monetic.xyz with a new effective date; continued use constitutes acceptance.
